Privacy Policy

This Privacy Policy (“Policy”) describes how the Cooperative of American Physicians, Inc. (“CAP,” “us,” “our,” or “we”) collects, uses, discloses, and otherwise processes Personal Information within the context of your relationship with CAP, which may include those we interact with in our business-to-business relationships or if you apply for a job with us. “Personal Information” as used in this Privacy Policy means information linked or reasonable linkable to an identified or identifiable individual. Specifically, this Policy applies to our websites that link to this Privacy Policy, including www.capphysicians.com, our mobile application, as well as our offline services.

Unless otherwise noted, this Policy describes our current practices, as well as our practices in the preceding twelve (12) months.

Collection of Your Personal Information

We may obtain the following types of Personal Information about you. The specific pieces of Personal Information we collect about you depends on your interactions with us and may not include all of the examples listed below.

  • Identifiers, such as your e-mail address, name, home or work address or telephone number.  
  • Personal Records, such as name, signature, Social Security number, address, telephone number, passport number, driver’s license or state identification card number, insurance policy number, education, employment, employment history, bank account number, credit card number, debit card number, or any other financial information, medical information, or health insurance information.
  • Protected Characteristics, such as age (40 years or older), race, color, ancestry, national origin, citizenship, religion or creed, marital status, medical condition, physical or mental disability, sex (including gender, gender identity, gender expression, pregnancy or childbirth and related medical conditions), sexual orientation, veteran or military status, genetic information (including familial genetic information).
  • Commercial Information, such as records of products or services purchased, obtained, or considered, or other purchasing or consuming histories or tendencies.
  • Internet or other similar network activity, such as IP address, browser type, domain names, access times, in-site tracking data, and referring Website addresses.
  • Geolocation, such as office location.
  • Sensory data, such as audio, electronic, visual, or similar information.
  • Professional or employment-related information, such as current or past job history.
  • Inferences drawn from other personal information, such as your preferences, behaviors, attitudes, intelligence, abilities, and aptitudes.
  • Sensitive Personal Information, such as Social Security number, driver’s license, state identification card, or passport number; racial or ethnic origin, citizenship or immigration status, religious or philosophical beliefs, or union memberships.

We may modify Personal Information, such as through de-identification or aggregation, to render the information no longer identifiable. We maintain and use this information only in its nonidentifiable form and do not attempt to re-identify the information. 

Cookies and Other Tracking Technology

We may use a variety of tracking technologies, including cookies, beacons, pixels, and SDKs that collect certain information when you interact with us. Depending on your device and browser settings, these tracking technologies may collect details about how you interact with us, including IP address, device identifiers, user preferences, approximate geolocation, the pages you click on, and the website you visited immediately beforehand. 

We may use these technologies for various purposes, including to provide functionality to our website, help us route traffic between servers, understand how our website is performing, how visitors use our website, improve features and content, and for advertising purposes. We may combine certain information collected through tracking technologies with other information we obtain about you, which may include information we obtain from our vendors. We or other parties may collect Personal Information about your online activities over time when you use our website.

Certain advertising tracking technology vendors may participate in the Digital Advertising Alliance (“DAA”) AdChoices Program and may display an Advertising Option Icon for Interest-based Ads that links to an opt-out tool which allows you to exercise certain choices regarding targeting. You can learn more about the DAA AdChoices Program at http://www.youradchoices.com/ and its opt-out program for mobile apps at http://www.aboutads.info/appchoices. In addition, certain advertising networks and exchanges may participate in the Network Advertising Initiative (“NAI”). NAI has developed a tool that allows consumers to opt out of certain interest-based ads delivered by NAI members’ ad networks. Please be aware that, even if you are able to opt out of certain kinds of interest-based ads, you may continue to receive non-targeted ads.

We may use Google Analytics. You can learn more about how Google Analytics collects and processes data at “How Google uses information from sites or apps that use our services” and in the Google Privacy Policy. Information about Google Analytics’ current opt-outs for web is available here.

In some cases, we may integrate the analytics services we use with certain advertising services that are also made available by our analytics providers. For example, we integrate Google Analytics with the following Google advertising features:

  • Remarketing with Google Analytics
  • Cross Device Remarketing & Reporting
  • Google Analytics Demographics & Interest Reporting
  • Google Display Network Impression Reporting

You can opt-out of Google Analytics advertising features directly with Google through its Ads Settings or by downloading the Google Analytics Opt-out Browser Add-on.

You may be able to adjust your browser settings to remove or reject cookies. Some browsers may have a “Do Not Track” setting. Please note that the website is not designed to respond to “Do Not Track” settings.

Sources of Personal Information 

We may collect your Personal Information from a variety of sources, including:

  • Directly from you, such as any in your application or in any communications you initiate with us.
  • Automatically, including when you use our website or our mobile application.

  • From other parties, including our service providers, information technology vendors, and other business partners.

If you no longer wish to provide us information through our mobile application, you may uninstall our mobile application from your device. Note that this action will not delete your user account or any information we previously collected via the mobile application nor does it affect our information collection on the website.

 

Use of your Personal Information

We may use your Personal Information for a variety of business and commercial purposes including: 

  • Providing our services, including communicating with you about products or services you have requested;
  • For advertising and marketing, including measuring the effectiveness of our advertising and marketing, and conducting surveys;
  • Internal business purposes, such as maintaining or servicing accounts, verifying customer information, or other similar services;
  • For quality, safety, and internal research, including evaluating our services, improving the quality of our services, tracking and responding to quality and security issues, and developing new or enhanced services;
  • For security and integrity, including detecting security incidents and protecting against malicious, deceptive, or illegal activity, enforcing our policies and terms, protecting our rights, and generally providing you with a secure experience;
  • For our recruiting and hiring purposes, including opening and maintaining your application records, communicating with you about your application, confirming eligibility, qualification, and background checks; communicating with any references, former employers, or other parties that provide information related to your candidacy; and providing you with relevant jobs and opportunities in your area; and
  • For our compliance purposes, including complying with applicable laws, regulations, or legal processes.

 

Disclosure of Personal Information

We may disclose the above categories of Personal Information for our business purposes to the following categories of third parties:

  • Service providers, including those who help us operate our business, provide customer support, provide payment services, and other functions such as email or mail;
  • Others, including:
    • As required and/or permitted by applicable laws;
    • In the event we sell or transfer all or a portion of our business assets (e.g., further to a merger, reorganization, liquidation, or any other business transaction), including negotiations of such transactions, in accordance with applicable laws;
    • Where we determine that disclosure of specific information is necessary to comply with the request of a law enforcement or regulatory agency or other legal process; or
    • To enforce our policies, or to investigate, prevent and take action regarding illegal activities, suspected fraud, to protect legal rights, propriety, or safety; or
    • When necessary to protect our company, our employees, our customers, or others.

We do not disclose personal information obtained for text messaging purposes (e.g., mobile phone number, opt-in consent information) to third parties for those third parties’ own marketing purposes.

 

Retention of Personal Information

We keep the categories of Personal Information described above for as long as necessary for the purposes described in this Policy or otherwise authorized by law. This generally means holding the information for as long as one of the following applies: 

  • Your Personal Information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the information.
  • Your Personal Information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which the Personal Information was collected.
  • Your Personal Information is reasonably required to protect or defend our rights or property.
  • We are otherwise required or permitted to keep Personal Information by applicable laws or regulations.

Where Personal Information is used for more than one purpose, we will retain it until the purpose with the latest period expires.

Third-Party Links

Our website may contain links to third-party websites and include embedded content that is hosted by such third parties. CAP is not responsible for the privacy statements or other content on websites that we do not control.

Updates to this Policy

We reserve the right to make changes to this Policy. These changes will take effect immediately upon posting. For your convenience, the last updated date of the current Policy will be posted at the top of this page. By continuing to use our services following such changes, you will be deemed to have agreed to such changes. If you do not agree to the changes in our Policy, it is your responsibility to stop using our services.

California Rights

Residents of California have certain rights to their Personal Information under the California Consumer Privacy Act (“CCPA”). This includes:

  • Right to know what Personal Information we have collected about you, including:
    • The categories of Personal Information, including:
      • The categories of sources from which the Personal Information is collected;
      • The business purpose for collecting, using, sharing, and selling Personal Information;
      • The categories of recipients to whom we disclose, sell, or share Personal Information; and
    • The specific pieces of Personal Information we have collected about you.
  • Right to request that we delete the Personal Information we collected from you, subject to certain exceptions.
  • Right to request that we correct inaccurate Personal Information that we maintain about you.
  • Right to opt-out of the sales or sharing of your Personal Information. To opt-out of the sales or sharing of your Personal Information, click the “Do Not Sell My Personal Information” link in the footer of our website. 

We do not use or disclose sensitive Personal Information for purposes to which the right to limit use and disclosure applies under the CCPA, and we do not use your sensitive Personal Information to infer characteristics about you. We do not currently engage in automated decision-making as defined by the CCPA.

We will not discriminate or retaliate against you for choosing to exercise any of your California privacy rights.

To exercise any of these rights, please submit a request to privacy@CAPphysicians.com or call us at 800-356-5672.  Please note that when submitting a request, you may be asked to provide information so we can verify your identity before action is taken. You may designate an authorized agent to make the request on your behalf. An authorized agent must submit proof to us that he or she has been authorized by you to act on your behalf, and you may still need to verify your identity directly with us before we can process the request.

Sales and Sharing of Personal Information

We may sell and/or share your Personal Information for cross-context behavioral advertising. Specifically, we may sell or share the following categories of Personal Information:

  • Identifiers, including name, phone number, and email address; and
  • Internet or other electronic network activity.

We may sell or share this Personal Information to third-party advertisers, data analytics providers, and our business partners. We may sell or share this information to conduct marketing and provide you with products or services you may be interested in. Please note that we do not knowingly sell or share the Personal Information of consumers under 16 years of age.

California's “Shine the Light” Law

California’s “Shine the Light” law permits California residents to request certain information regarding our disclosure of certain personal information to third parties for their own direct marketing purposes. If you are a California resident, you may request information about our compliance with the Shine the Light law by contacting us at privacy@CAPphysicians.com or by sending a letter to 333 S. Hope St, Los Angeles, CA 90071 ATTN: Legal Department/California Privacy Inquiry. Any such request must include “California Shine the Light Request” in the first line of the description and include your name, street address, city, state, and ZIP code. Please note that we are only required to respond to one request per customer each calendar year.
